Federal Circuit Affirms Summary Judgment on Non-Infringement in Microsoft Case
Klarquist attorneys helped our client Microsoft Corporation successfully prevail on summary judgment of non-infringement two years ago in the District of Oregon. The Court of Appeals for the Federal Circuit affirmed the District Court’s ruling in a decision published May 29, 2007.
The original case was filed in the District of Oregon in February 2004 by Motionless Keyboard Corporation, Inc. (MKC). MKC alleged that two of Microsoft’s Sidewinder joysticks infringed one patent and that Microsoft’s Strategic Commander game controller infringed a second patent. Microsoft, along with co-defendants Saitek Industries, Ltd. and Nokia, Inc., moved for Summary Judgment of Non-Infringement, which the District Court granted in May 2005. MKC subsequently appealed the case to the Federal Circuit, where it was argued and affirmed.
