Klarquist Wins Summary Judgment for Home Certified on Patent Invalidity

On February 5, 2026, the U.S. District Court for the District of Oregon entered judgment in favor of Home Certified, Inc. in Savannah Intellectual Property LLC v. H2OME Certified, Inc., Case No. 3:24‑cv‑00316‑AR. The Court granted summary judgment that all asserted claims of Savannah’s three patents directed to preventative moisture reduction systems in construction are invalid.

The district judge adopted in full, with clarification, the magistrate judge’s findings and recommendation and held that the asserted patent claims are invalid under 35 U.S.C. § 101 as directed to ineligible subject matter. The Court also addressed an alternative ground for invalidity raised by Home Certified, holding that the claims are invalid as obvious under 35 U.S.C. § 103. In a detailed opinion, the Court concluded that the claims were obvious in view of a 2001 Canadian publication, the CMHC Guidelines, which describes methods for drying wood framing in new construction, both alone and in combination with the IICRC S500 publication addressing established techniques for drying wet buildings.
