Klarquist Win in Huang v. Amazon.com, Inc.

On January 28th, the Federal Circuit ruled in Amazon’s favor in Xiaohua Huang v. Amazon.com, Inc. No. 5:23-cv-04679. The Court affirmed the district court’s ruling granting Amazon’s motion to dismiss Huang’s complaint, finding that Huang had failed to adequately explain his EEPROM chip infringement theory or identify how the chips were used in the accused products with the requisite specificity.  It also found the district court had properly denied Mr. Huang further leave to amend the complaint because he had failed to correct the defects Amazon raised when he filed previous amendments.
