Amicus Brief Submitted in En Banc Federal Circuit Case Regarding Laches

On April 21, 2015, Klarquist submitted an amicus brief to the Federal Circuit on behalf of a group of companies, asking the Court to reaffirm the viability of the laches defense in patent law. The amicus brief, filed in connection with the pending en banc rehearing of SCA Hygiene Products Aktiebolag v. First Quality Baby Products, LLC, No. 2013-1564 (Fed. Cir.), argues that the recent Supreme Court copyright decision in Petrella v. Metro-Goldwyn-Mayer, Inc., 134 S. Ct. 1962 (2014), does not alter the policy considerations underlying the historical availability of the laches defense in patent cases.
