AMI Successfully Enforces its Trademark in Court
Klarquist’s client Associated Master Inspectors, LLC, dba AMI, prevailed this week in a two-day trial in the Oregon Circuit Court for the County of Yamhill in McMinnville, Oregon on its state and federal trademark infringement claims against another company using “AMI” in a related service area. AMI was formed in 2000 and since then has inspected residential and commercial buildings throughout Northwest Oregon and Southwest Washington under its “AMI” service mark. The defendant began using the AMI mark for mold and other air quality testing services beginning in late 2009.
Circuit Court Judge Cynthia L. Easterday found that Defendant AMI Environmental Testing Northwest was infringing upon the mark “AMI” and that Associated Master Inspectors, LLC is entitled to injunctive relief permanently enjoining and restraining Defendant from further use of the AMI mark.
