International Patents

The concept of patenting inventions is well established in the industrialized world.  Most countries participating to any significant extent in the global economy have their own patent laws and/or participate in regional patent protection systems.  Consequently, many clients, especially corporate clients having international markets and/or sources of supply, recognize the importance of obtaining and enforcing patents in foreign countries.

To facilitate international protection of intellectual property, many countries (including the United States) have entered into treaties to harmonize their patent laws.  Nevertheless, each country's patent laws have their own respective nuances, such as the scope of available protection, time limits for filing for protection, interpretation, procedure, and enforcement.  The ability to address such issues typically requires specialized knowledge and experience as well as specific certification by practitioners in the particular country.  Consequently, Klarquist Sparkman has developed relationships with patent practitioners in all of the major industrialized countries and regions of the world.  The Firm works closely with these associates on behalf of our clients to obtain and enforce patents in countries and regions of interest.  Our relationships with some of these practitioners have been ongoing for decades.

Klarquist Sparkman has also filed many international patent applications under the Patent Cooperation Treaty (PCT), which can provide our clients with a way to postpone certain costs associated with filing foreign patent applications in countries or regions designated by the PCT application, while preserving their ability to seek international protection in such designated countries.
